8.11.21 VDOE Letter of Findings: Noncompliance for Convening Eligibility and IEP Meetings Without Parent

August 11, 2021, VDOE released a Letter of Findings (LOF) in which it found Fairfax County Public Schools (FCPS) in Virginia in noncompliance for convening eligibility and IEP meetings without the parent.

VDOE’s investigation and issuing of its LOF were in response to a complaint filed June 22, 2021, by a parent with a child enrolled in FCPS.

I’d like to thank the parent for providing permission to post the LOF here.

By sharing these documents, we 1) help educate each other, 2) help make each other aware of the noncompliance occurring in our districts, and 3) gain tools to use when writing our own complaints.

My hope is that the analysis made by VDOE and how it interpreted and applied different regulations will 1) help other parents as they advocate for their children and 2) help educate the educators who are ignorant of the process.

In addition, the LOF provides a view of how a state investigates and how it expresses the result of its investigations. In VDOE’s case, it is common to find opinions and random editorializing inserted within their LOFs.
